Although I'm only a semi-fan, I subscribed because I was looking for
opinions on how Steve Smith avoided being arrested and charged for
assault. An assault with multiple witnesses, some of it photographic in
nature.

I attempted to respond ten days ago, but have been having server
problems. Finally solved the server issues by finding a new one to
use, so......

I am not a lawyer.

But it's my opinion that if the person who is assaulted (K. Lucas)
doesn't want to press charges against the person who assaulted him (S.
Smith), then typically no arrest is made. So... I believe Lucas
could have had Smith arrested, but decided it wasn't necessary.

As to the question in the subject line; this would be a FAQ for this
newsgroup and the answer seems to be the Panther fans are all hanging
out in Web forums. The most popular forum seems to be:

I think Usenet is clearly superior to Web forums, but this seems to be
a minority opinion the past few years.

Doubtful, I would think. This would mean that one could assault someone
and then intimidate them not to press charges. IIRC, prosecution in
assaults are not dependent on the cooperation of the victim,
particularly if there are witnesses. This is why, when the police in NC
are called out to an assault, someone is going downtown if there is
evidence, even if the victim refuses to press charges. This rather
recent law was targeted towards spouses, but I think it could apply
under a variety of circumstances. I hope the fact that celebrity or the
involvement of multimillionaires didn't trump the law.

Perhaps you supplied the answer when you said: "when the police in NC
are called out to an assault, someone is going downtown if there is
evidence, even if the victim refuses to press charges." I wouldn't
expect Panther's management would call the cops on Steve Smith. Well,
maybe for murder - but not for a fight. Even if a nose was broken.

If you witness a crime being committed, I think you are obligated to
report it. And, there were various witnesses not associated with the
Panthers organization. Surely the Police couldn't/shouldn't ignore a
crime if they only become aware of during or shortly after its
commission. It's not as if there is any doubt that an assault did take
place. However, I realize I'm not objective. I can't believe that boxing
promoters and boxers aren't arrested after every fight.
